The Legacy Leadership Lab FAQ’

1. What is the Legacy Leadership Lab?

The Legacy Leadership Lab is an educational and professional-development program designed for financial professionals and insurance professionals who want to become more confident discussing legacy planning concepts with their clients. The program focuses on education, client communication, coordination, practice development, and understanding how legacy planning may fit within a client’s broader financial picture.

The Legacy Leadership Lab is not a law firm and does not provide legal advice or train financial professionals to practice law.

2. Does the Legacy Leadership Lab teach advisors how to prepare trusts or other legal documents?

No. The Legacy Leadership Lab does not train advisors to draft, interpret, modify, select, or provide legal advice regarding trusts, wills, deeds, powers of attorney, or other legal documents.

The Lab educates advisors about the role these documents may play within a broader legacy-planning conversation so they can recognize when a client may need assistance from an appropriately licensed attorney or attorney-led legal service.

3. What is the advisor’s role in the legacy-planning process?

The advisor’s role is primarily one of education, discovery, appropriately licensed financial or insurance services, and coordination. Advisors can help clients identify financial objectives, organize financial information, discuss beneficiary considerations, and understand why having an appropriate legacy plan may be important.

Legal questions and decisions involving the preparation, interpretation, or appropriateness of legal documents must be handled by appropriately licensed legal professionals.

4. Is the Legacy Leadership Lab a law firm or legal-services provider?

No. The Legacy Leadership Lab is an educational and advisor-development program. Neither the Lab nor Chambers O’Brien represents itself as a law firm through the program, and participation in the Lab does not authorize an advisor to provide legal services.

When legal services are required, those services must be provided through an appropriately licensed attorney or other legally authorized provider.

5. How does Estate Guru fit into the process?

Estate Guru is an attorney-led estate-planning platform utilized within the Legacy Leadership Lab process where appropriate. The platform provides a separate legal-services component and attorney involvement for matters requiring legal judgment.

Financial professionals participating in the Lab do not replace the attorney, make legal determinations for the attorney, or independently provide legal advice.

6. Can an advisor recommend what type of trust a client should establish?

An advisor should not independently make legal determinations regarding which legal instrument, trust structure, deed, or estate-planning document is appropriate for a particular client.

Advisors may educate clients about general legacy-planning concepts and identify circumstances that may warrant further legal consideration. The determination of what legal documents are appropriate for a client should be made by a qualified legal professional based upon the client’s individual circumstances.

7. Does participating in the Legacy Leadership Lab allow an advisor to offer estate planning?

Participation allows advisors to become better educated about legacy-planning conversations and coordination, but it does not provide a license to practice law.

Advisors should clearly distinguish between financial or insurance-related services they are appropriately licensed to provide and legal services that must be performed by an attorney or other authorized legal professional.

8. Will using this process guarantee that a client’s family avoids probate?

No. Neither the Legacy Leadership Lab nor participating advisors guarantee that probate will be avoided or that any particular estate-planning, financial, tax, or legal result will occur.

Whether an asset is subject to probate can depend upon ownership, beneficiary designations, titling, applicable state law, the client’s circumstances, and whether a legal plan has been properly created, executed, funded, and maintained.

9. Does the Legacy Leadership Lab provide tax advice?

The Lab may provide general education concerning the relationship between taxes, retirement planning, beneficiary planning, and legacy planning. However, generalized educational information should not be considered individualized tax advice.

Clients should consult with their qualified tax professional, CPA, attorney, or other appropriate professional regarding their individual tax circumstances.

10. Why should financial professionals understand legacy planning if they are not attorneys?

Financial decisions and legacy decisions are often interconnected. Account ownership, beneficiary designations, insurance, retirement accounts, investments, taxes, and family objectives can all influence a client’s broader legacy.

Understanding these connections helps an advisor recognize important questions, communicate more effectively with clients, and coordinate with the client’s attorneys, tax professionals, and other professionals without attempting to perform their work.

11. Is the Legacy Leadership Lab designed to sell trusts?

No. The purpose of the Legacy Leadership Lab is not to manufacture or sell legal documents.

The program is designed to improve advisor education, client discovery, communication, coordination, and awareness surrounding legacy planning. Whether a client requires any particular legal document is an individualized legal determination that should be made through the appropriate legal process.

12. Are advisors compensated for providing legal advice or selecting legal documents?

Neither The Legacy Leadership Lab nor a participating financial professional receives compensation for providing legal advice, selecting legal documents, or exercising legal judgment. Any financial-professional or administrative compensation must relate solely to separately authorized nonlegal services and may not constitute a division of legal fees or compensation for directing a client to a particular attorney.

13. Does every client need a trust?

No. There is no single estate-planning solution that is appropriate for every person or family.

A client’s needs may vary significantly based upon assets, family circumstances, state of residence, ownership arrangements, beneficiary designations, tax considerations, personal objectives, and other factors. The appropriate legal strategy should be determined individually with qualified legal counsel.

14. What should an advisor do when a client asks a legal question?

The advisor should recognize the boundary between education and legal advice.

An advisor can explain general concepts and help the client formulate questions, but questions involving the meaning of a legal document, interpretation of law, legal rights, legal consequences, document selection, or a recommended legal course of action should be referred to an appropriately licensed attorney.

A simple standard advisors can remember is: Educate. Identify. Coordinate. Refer.

Do not independently diagnose the client’s legal situation or prescribe the legal solution.

15. What is the ultimate objective of the Legacy Leadership Lab?

The objective is to help financial professionals develop a more thoughtful and coordinated approach to conversations about family, assets, retirement, beneficiary planning, and legacy.

The program encourages advisors to identify issues earlier, ask better questions, document client objectives, work collaboratively with qualified professionals, and help clients understand the importance of completing and maintaining an appropriate plan.

The Legacy Leadership Lab believes that meaningful legacy planning begins with preparation, education, communication, and professional collaboration.

Legacy Planning is the Purest Form of Love.

Legal & Compliance Disclosure

The Legacy Leadership Lab is an educational and professional-development program for financial professionals. It is not a law firm and does not provide legal advice or legal services.

When a client engages a licensed attorney available through Estate Guru’s attorney-led platform, the attorney-client relationship exists solely between the client and the attorney or law firm providing legal services. The attorney maintains independent professional judgment and is solely responsible for legal advice, legal determinations, document recommendations, preparation, interpretation, and other matters constituting the practice of law.

Participating financial professionals do not act as attorneys, provide legal advice, determine which legal documents are appropriate, draft or modify legal documents, interpret legal documents, or direct or control an attorney’s legal judgment. They may provide general legacy-planning education, gather factual financial and asset information, and coordinate communication among the client and appropriate financial, tax, insurance, and legal professionals.

Clients remain free to select legal and tax professionals of their own choosing and are not required to use an attorney available through Estate Guru.

Legal services are not conditioned upon the purchase of financial or insurance products, and legal strategies or documents are not selected based upon such purchases. Any financial or insurance recommendation must be evaluated independently based upon the client’s circumstances and applicable licensing, suitability, best-interest, fiduciary, disclosure, and supervisory requirements.

Participation in The Legacy Leadership Lab does not create an attorney-client relationship with the Lab, and no legal, financial, tax, investment, insurance, or estate-planning outcome is promised or guaranteed.
